High court weighs retrial in Costa Mar negligence case after jury deadlock

The Federal Court of Zandoria heard oral arguments on Tuesday in the appeal of Vargas v. the State, a case that has divided Costa Mar for more than a year. The case concerns criminal negligence charges against a caregiver, Rosario Vargas, who was accused of failing to supervise three children in her care, resulting in their deaths by drowning in a private pool. A jury of twelve deliberated for eight days in July before the foreman declared a deadlock; the judge declared a mistrial, and Vargas walked free—at least temporarily. The prosecution has appealed, arguing that a retrial should proceed. Vargas's defence counsel argues that a second trial would violate the principle against double jeopardy enshrined in the Federal Charter.

The children's family—the parents who hired Vargas—has also remained silent, though friends say they are devastated by the prospect that the case may never reach closure.
